1. AIDBYLAW.COM ONLY PROVIDES A MEDIUM FOR INTERACTION
AIDBYLAW is an internet portal that facilitates communication between professionals and potential users of professional services. AIDBYLAW acts as a venue (platform or website) for providers and consumers of professional services to exchange information with the goal of eventually forming a professional relationship.
2. USER GUIDELINES
Users of AIDBYLAW are granted a non-exclusive, limited right to access and use the Service in accordance with the rules described in this Agreement. To ensure a safe and productive environment, Users must adhere to the following guidelines. The User further agrees that this defense and indemnity shall include, without limitation, legal fees and costs. AIDBYLAW reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User, and the User shall not settle any matter without the written consent of AIDBYLAW.
10. PAYMENT TERMS
The User, as a buyer or purchaser of any service from AIDBYLAW.COM(“AIDBYLAW”), acknowledges that initiating a payment transaction constitutes a legally binding agreement with AIDBYLAW to purchase the selected products/services. Payments may be made through electronic payment methods, cheques, demand drafts, pay orders, cash on delivery, or any other payment facility authorized by the Reserve Bank of India (RBI) for payment processing, collection, refunds, and remittance.
By making a payment through any electronic payment method, the User warrants that the provided banking details, including debit/credit card information, are accurate and complete. The User further assures that the payment will be duly honoured by their respective bank, debit/credit card issuer, or financial institution.
Payment details entered by the User are processed directly on the Third-Party Payment Service Provider’s platform. AIDBYLAW does not access, store, or retain any payment-related information entered by the User.
AIDBYLAW reserves the right to decline or refuse payment from any User at its sole discretion. In cases where payment has already been processed and the order is subsequently cancelled, AIDBYLAW will initiate a refund within seven (7) working days from the date of cancellation.
All transactions involving valid credit/debit cards, mobile wallets, or other electronic payment instruments are processed through a Third-Party Payment Service Provider. The use of such services is governed by the terms and conditions of the respective Payment Issuing Bank and the Third-Party Payment Service Provider. AIDBYLAW holds no responsibility or liability for the operational behaviour, features, or content of these financial institutions or third-party service providers.
11. CANCELLATION AND REFUND POLICY
AIDBYLAW.COM (“AIDBYLAW”) is committed to providing high-quality services at reasonable and affordable prices. However, we understand that there may be instances where a User wishes to cancel an order or request a refund.
a) Cancellation Policy
If a User has made a payment for a service but later decides not to proceed, they may cancel their order within 4 hours of payment or before the service has commenced, whichever is earlier. If the service has already begun, the order cannot be cancelled, and the refund policy will apply.
b) Refund Policy
A User may request a refund under the following conditions:
If the refund falls under a Money Back Guarantee scheme that is clearly published on the Website or communicated in writing via an electronic medium, and the User meets all applicable terms and conditions.
If there is a delay in service delivery beyond the communicated timeframe, and such delay is solely attributable to AIDBYLAW.
c) Refund Request Procedure
Users must submit a refund request by emailing [email protected], including their Order ID and the reason for the request.
Upon receiving the request, AIDBYLAW’s Senior Management will review and determine if the refund request is valid, based on the outlined conditions.
AIDBYLAW reserves the sole discretion to approve or reject any refund request.
d) Refund Processing
If a refund is approved, only the professional fees paid for the service will be refunded. Any government fees or taxes paid are non-refundable.
The maximum refund amount will not exceed the amount originally paid by the User for the service.
Approved refunds will be processed and credited to the User’s account within 10 to 15 working days from the refund approval date.
12. TERMINATION, SUSPENSION, OR DISCONTINUATION OF SERVICE
AIDBYLAW reserves the right, at its sole discretion, to modify, suspend, or discontinue the Website, Application, or any of its services, whether temporarily or permanently, with or without prior notice to the User.
The User acknowledges and agrees that AIDBYLAW shall not be liable to the User or any third party for any modification, suspension, or discontinuation of services. Additionally, AIDBYLAW reserves the right to terminate access to its services without prior notice, for any reason it deems appropriate.
In the event of termination, the User understands and agrees that AIDBYLAW may immediately delete data and files stored in the User’s account and restrict any further access to such data or services. AIDBYLAW shall not be held responsible for any loss of information or inconvenience arising from such actions.
13. DISPUTE RESOLUTION AND JURISDICTION
In the event of any dispute or disagreement between the User and AIDBYLAW.COM (“AIDBYLAW”), the resolution process shall be as follows:
a) Amicable Settlement: Both parties shall first attempt to resolve any disputes or disagreements amicably through direct, informal negotiations. If such negotiations fail to resolve the dispute within 30 days from the date of initiation, the matter shall proceed to arbitration.
b) Arbitration: If an amicable resolution is not achieved, the dispute shall be referred to arbitration by a Sole Arbitrator, mutually appointed by both parties. The arbitration shall be conducted in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended from time to time). The decision of the Arbitrator shall be final and binding on both parties.
c) Venue and Language: The arbitration proceedings shall be held in Faridabad (Haryana), and the language of the arbitration shall be English.
d) Governing Law and Jurisdiction: This Agreement shall be governed by and interpreted in accordance with the laws of India, specifically as applicable to the National Capital Territory (NCT) of Delhi. Subject to the arbitration process mentioned above, the courts at New Delhi shall have exclusive jurisdiction over any legal proceedings arising from this Agreement.
14. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
At AIDBYLAW we strive to provide reliable and high-quality services. However, as with any online platform, unforeseen issues may arise, including system errors, service interruptions, or actions by users that may negatively impact others. While we take reasonable precautions to maintain the integrity of our platform, we cannot be held responsible for the actions of individual users or for any technical issues beyond our control.
(a) Disclaimer of Warranties
The User expressly acknowledges and agrees that the use of AIDBYLAW’s services is at the User’s sole risk. The services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. AIDBYLAW disclaims all warranties, including but not limited to:
I. Merchantability, fitness for a particular purpose, and non-infringement.
II. Service availability, uninterrupted access, security, or error-free operation.
III. Accuracy or reliability of any information, results, or outcomes derived from using the services.
IV. Correction of defects or errors in the software, content, or services.
AIDBYLAW makes no warranty regarding any goods, services, or information obtained through the platform or any transactions conducted through it. No advice or information, whether oral or written, obtained from AIDBYLAW shall create any warranty not expressly stated in this agreement.
(b) Limitation of Liability
To the maximum extent permitted by law, AIDBYLAW shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:
I. The use or inability to use the services.
II. The cost of procuring substitute goods or services.
III. Any goods, services, information, or transactions obtained through the platform.
IV. Unauthorized access to or alteration of User’s data or transmissions.
V. Loss of profits, data, goodwill, or other intangible losses, even if AIDBYLAW has been advised of the possibility of such damages.
Furthermore, AIDBYLAW shall not be liable for any service interruption, suspension, or termination, whether caused by technical failures, necessary maintenance, external factors, or other unforeseen circumstances, regardless of whether such actions were justified, negligent, intentional, or inadvertent.
By using AIDBYLAW’s services, the User acknowledges and agrees that they assume all risks associated with its use and that AIDBYLAW’s liability is strictly limited to the fullest extent permitted by law.
15. ENTIRE AGREEMENT
This Agreement constitutes the entire and exclusive agreement between the User and AIDBYLAW and serves as the complete and final statement of the terms governing the User’s use of the Website and Services.
This Agreement supersedes all prior or contemporaneous communications, understandings, or agreements, whether written or oral, between AIDBYLAW and the User concerning the subject matter herein.
If, at any time, the User does not agree with these Terms and Conditions, they should discontinue the use of the Website and Services immediately.
AIDBYLAW reserves the right to modify or update these Terms and Conditions at any time, without prior notice. It is the User’s responsibility to periodically review the Terms and Conditions to stay informed of any changes.
